What is a County Court Judgement?

If you have defaulted on a debt, a creditor or claimant has the right to submit a claim through the County Courts to recover the money that you owe. The legal process will usually commence with a County Court Claim Form, or Summons, which will be issued by the Court - this will show the amount of money owed to the creditor or claimant.

If you receive a letter informing you that someone is making a County Court Claim, stating that you owe them money, don't panic. The Court will decide whether you have to pay the debt and how you should repay.

You only have 14 days to reply to the County Courts. It is very important that you respond quickly. You will have to complete an Income and Expenditure Form and make an offer of payment. If you do not respond to the claim within the 14 days, or you ignore the claim, this can allow the creditor or claimant to request a Judgement by default, which could mean you have to pay the outstanding debt in full, plus costs. In some cases we can get an extension of 14 days for existing clients by filling in a form on their behalf online.

After the court hearing, the court may issue an order or county court judgement saying you must repay the debt - this order is called a CCJ and will either be for the amount agreed between you and your creditor, or a payment set by the court.
